Under Nebraska’s compulsory education law, school-aged children under the age of 18 must be enrolled in and attend an educational program. If a student misses 20 or more unexcused days of school, the school may refer the student to our office to request court intervention. The County Attorney’s office reviews all non-attendance referrals, and one of the following decisions is made: a the matter is filed on in juvenile court, the family is offered diversion, or the County Attorney decides to take no action at that time.
